Da es aber erfahrungsgem?? h?ufig der Fall ist, dass der K?ufer einer Wohnung sie sp?ter selbst nutzen will, also die Wahrscheinlichkeit einer Kündigung wegen Eigenbedarfs steigt,ugg shoes, haben Mieter in einer solchen Situation einen besonderen Kündigungsschutz: Der neue Eigentümer darf sich frühestens nach drei Jahren, in besonderen F?llen sogar erst nach zehn Jahren auf Eigenbedarf berufen. Allerdings greift der Kündigungsschutz nur bei “echten Umwandlungsf?llen”. Diese definiert das Gesetz folgenderma?en: Eine bereits vermietete Wohnung wird in eine Eigentumswohnung umgewandelt und anschlie?end verkauft. Hier liegt die Begründung des BGH: In dem aktuellen Fall wurde zun?chst das Anwesen an die GbR verkauft, die die Wohnungen anschlie?end selbst in Eigentumswohnungen umwandeln will. Da es sich zum Zeitpunkt der Kündigung aber noch um eine Mietwohnung handelt, ist eine Eigenbedarfskündigung laut BGH berechtigt. Ob die Bedingungen für einen Eigenbedarf tats?chlich erfüllt sind, wird allerdings noch geprüft.
